Tactical and Psychological Principles of Interrogation during the Investigation of Criminal Offenses in the Field of Economic Activity Related to Document Forgery
Abstract
Abstract. One of the most common investigative (detective) actions during the investigation of criminal offenses is interrogation. Interrogation is the most significant, indispensable investigative (detective) action, since by receiving testimony during interrogation, the investigator collects ideal traces that comprehensively complement other sources of forensically significant information, ensuring the process of proving. The purpose of the scientific article is to form the principles of interrogation tactics during the investigation of criminal offenses in the field of economic activity related to document forgery, from the point of view of criminal procedure, forensic and psychological aspects. The regularities of interrogation are revealed, in particular the key one is the cognitive nature, which is expressed in the consistent reflection of the event of a criminal offense in a person’s memory. The reflection is influenced by objective and subjective factors. In the context of considering interrogation tactics during the investigation of criminal offenses in the field of economic activity related to document forgery, the issue of using the capabilities of cognitive psychology and the psychology of lying is revealed, in particular under conditions when difficulties arise with activating the memory of interrogated persons who are ready to cooperate with the investigation, or with reflecting truthful information, as a result of its distortion or silence by interrogated persons as a form of counteraction to the pre-trial investigation. These circumstances are due to the fact that the suspect involved in the mechanism of illegal activity, and in some cases also an unscrupulous witness, are characterized by a high level of education, well-developed professional abilities, are mainly representatives of the so-called "white-collar" crime, which necessitates thorough preparation of the investigator for interrogation and direct receipt of testimony in compliance with forensic recommendations.
